High Court Drama as Lawyer Danstan Omari is Kicked Out During Abduction Case Involving Murkomen

Prominent city lawyer Danstan Omari was on Wednesday, January 8, ejected from the Milimani High Court during proceedings related to an abduction case involving Interior Cabinet Secretary Kipchumba Murkomen.

Justice Bahati Mwamuye issued the order after Omari interrupted fellow advocate Evans Ogada, who was making submissions to suspend the proceedings due to the absence of Inspector General (IG) of Police Douglas Kanja and National Transport and Safety Authority (NTSA) Director General George Njao.

Omari, representing Murkomen, requested to remain in the courtroom despite the court’s earlier decision to strike him from representing his client. 

“My lord, I didn’t want us to go that way. What I was only requesting was, can I sit and listen, or couldn’t listen? I am not an advocate; the court has already struck me from representing my client,” Omari stated.

However, Justice Mwamuye instructed Omari to leave the courtroom, asserting that Murkomen’s case was still being represented by other lawyers. 

“Please obey the court,” the judge told Omari, who then collected his belongings and left the courtroom.

Earlier in the session, lawyer Paul Nyamodi, representing IG Kanja, informed the court that Kanja was unable to attend the hearing due to urgent security matters. 

Nyamodi explained that while Kanja could not be reached directly, the IG’s office communicated that he had left for an urgent security meeting. Nyamodi requested a 14-day extension to allow for statement-taking and to conclude investigations.

The absence of IG Kanja marked the second consecutive time he had missed court proceedings. 

Justice Mwamuye adjourned the hearing until 12:10 p.m. to allow for efforts to locate the IG. 

The judge warned that if both Kanja and Director of Criminal Investigations (DCI) boss Mohammed Amin failed to appear a third time, the court would consider holding them in contempt and issuing immediate sentences.

Murkomen, who was also absent from the court, has denied any involvement in the alleged abductions and is seeking to have his name removed from the petition filed by the Law Society of Kenya (LSK), which links him and other senior government officials to the alleged abductions.

In a related development, Justice Mwamuye summoned IG Kanja to court to explain how the abductions occurred without police intervention.

The judge also instructed NTSA Director-General Njao to provide details of vehicles allegedly used in the abductions before the next court session.
