Evidence from the Office of the Clerk of the National Assembly has been formally tabled in the Senate for the impeachment of Deputy President Rigathi Gachagua.
This follows the approval of a Special Motion in the National Assembly on October 8, 2024, where 282 members voted in favor of impeachment against 44 votes against.
In a statement dated Tuesday, October 15, the National Assembly noted that the Speaker of the Senate Amason Kingi confirmed the whole Senate would preside over the impeachment trial.
The hearing will take place from Wednesday, October 16 to Thursday, October 17, 2024.

"The Office of the Clerk of the National Assembly has formally submitted evidence to the Senate regarding the impeachment of Deputy President H.E. Rigathi Gachagua, EGH," the statement read in part.
"This follows the passage of a Special Motion by the National Assembly on Tuesday, October 8, 2024, where 282 members voted in favor of the impeachment of the Deputy President, while 44 opposed."
The Special Motion, tabled by Kibwezi West MP Hon. Mwengi Mutuse, lists 11 articles of impeachment, inclusive of charges for gross violation of the Constitution.
He is accused of undermining the authority of President William Ruto, the Cabinet, and obstructing the conduct of the national government functions appropriately.

He has also been accused of undermining devolution and violating Article 160(1) of the Constitution, which guarantees judges independence in making their decisions.
If these claims are found credible by the Senate members, it would lead to his removal from office.
For such a motion to sail through, at least two-thirds of the Senate, translating to 67 members, have to support it in line with Article 260 of the Constitution.
At least 45 senators would have to show up and support the motion for Gachagua to face removal from office as is stipulated in Article 145 of the Constitution.

Gachagua would be the first Deputy President in the history of Kenya to be thrown out through impeachment if the Senate votes for the impeachment.
Meanwhile, Chief Justice Martha Koome has constituted a three-judge bench to hear and determine the petition challenging the impeachment of Deputy President Gachagua.
The Bench shall be composed of Justice Eric Ogola, Lady Justice Dr Freda Mugambi, and Justice Anthony Mrima.
