Deputy President Rigathi Gachagua at a past event |
The DP was accused of several violations, including corruption, money laundering, and gross misconduct.
Filed by Kibwezi West MP Mutuse Eckomas Mwengi, the motion alleged that Gachagua acquired assets that were inconsistent with his salary.
It further declares that the second in command has contravened various laws, including the Proceeds of Crime and Anti-Money Laundering Act.
Gachagua is further accused of uttering public statements that amount to ethnic incitement, an apparent contravention of Article 10 of the Constitution that provides for national values and principles.
He is also accused of gross misconduct for uttering adverse sentiments in public against a High Court judge and the Director General of the National Intelligence Service.
The next phase in the impeachment process is a review by the Clerk of the National Assembly.
Parliament of Kenya in session |
“The Clerk to the National Assembly will review the motion and advise the Speaker on its admissibility based on the grounds in support of the motion and the number of members who will have appended their signatures in support of the motion,” the motion states in part.
For the motion to sail through, it must be supported by a third of the National Assembly members which translates to 117 MPs.
If it receives the necessary support, the Speaker of the National Assembly shall notify the Speaker of the Senate within two days.
"If the impeachment motion is supported by no less than two-thirds of all members of the National Assembly, the Speaker shall inform the Speaker of the Senate of that resolution within two days," read the motion.
The Senate will thereafter, within seven days convene and listen to the charges against the Deputy President.
A hearing shall be held in the Senate where both sides shall be accorded an opportunity to be heard.
If two-thirds of the Senators support the impeachment after the hearing, Gachagua will cease to hold office as the Deputy President.
